Landlord Plumbing Obligations in Victoria — What the Law Requires

Victoria’s rental laws set clear obligations for landlords around plumbing maintenance and repairs. Getting this wrong exposes you to VCAT compensation claims, rent reduction orders, and regulatory penalties.

The General Obligation: Minimum Standards

Under the Residential Tenancies Act 1997 (Victoria) and associated regulations, landlords must maintain rental properties in a state of good repair and comply with minimum rental property standards. For plumbing, this includes ensuring the property has:

  • A functional water supply connected to the property
  • Functioning hot water
  • Functioning toilet facilities
  • Functioning shower or bath
  • A kitchen sink with running water

These are not optional. A property that cannot provide any of the above cannot legally be rented in Victoria.

Urgent Repairs — 24-Hour Response Required

Victorian law defines certain plumbing issues as urgent repairs requiring attendance within 24 hours:

  • No hot water
  • No water supply to the property
  • Burst pipe or major water leak
  • Blocked or overflowing toilet (where only one toilet exists)
  • Sewage overflow
  • Gas leak (call gas network immediately, then a gasfitter)
  • Flooding or serious storm damage to plumbing

Failure to respond to an urgent repair within 24 hours allows the tenant to arrange their own repair (up to $2,500) and claim the cost from the landlord or rental bond.

Non-Urgent Repairs — 14-Day Timeframe

For non-urgent plumbing repairs (slow drain, dripping tap, running toilet, low water pressure), the landlord has 14 days from written notice to complete repairs. Failure to meet this timeframe allows the tenant to apply to VCAT for a repair order.

Gas Appliance Servicing (2-Year Rule)

All gas appliances in a rental property — gas heaters, ducted heating, gas cooktops — must be serviced by a licensed gasfitter every 2 years. Records must be kept and available to tenants on request. This is a minimum rental standard, not a recommendation.

Smoke Alarms and Water Efficiency

Separate from general plumbing, landlords must ensure:

  • All tapware and showerheads are 3-star WELS water efficiency rated or better (to pass water usage costs to tenants)
  • Toilets are 3-star WELS rated or better

If fixtures don’t meet WELS standards, landlords cannot legally require tenants to pay water usage charges.

  • Have a 24/7 plumber on call — urgent repairs are unavoidable; your response time determines your legal exposure
  • Schedule gas appliance servicing every 2 years proactively, not reactively
  • Document all repairs with invoices and completion dates
  • Respond to all repair requests in writing for a paper trail
